Contesting the Plan/Planning the Contest: Discovery in Probate Litigation


Speakers will present and discuss the various steps in a will contest proceeding and follow through discussing the steps after filing the contest with the court, to include the steps in the discovery process during the will contest proceeding. Sponsored by the Dallas Bar Association's Probate, Trusts & Estates Section. 

Jim Hartnett, Jr., Partner, The Hartnett Law Firm

Jim has been a lead attorney in many of Texas’s biggest probate and trust cases in counties all over Texas. He has tried many probate and trust cases to verdict and has argued numerous cases in various appellate courts around the state; including, the Texas Supreme Court.
After graduating from Cistercian Preparatory School, Jim enrolled at Austin College in Sherman, Texas, where he played varsity basketball while obtaining a degree in business administration. Upon graduation, he entered the University of Texas School of Law and was admitted to the State bar in 1983.
Jim has been a partner in The Hartnett Law Firm since 1988. He is a member of the Dallas Bar Association and the State Bar of Texas. Jim is a past council member of the Dallas Bar Association – Probate and Estate Planning Section and a fellow of the Texas Bar Foundation.

Scott D Weber, Member, Calloway, Norris, Burdette, Weber & Baxter-Thompson, PLLC

Scott D. Weber is a trial lawyer and a member of Calloway, Norris, Burdette, Weber & Baxter-Thompson, PLLC, in Dallas, Texas. Scott’s practice involves contested probate and fiduciary litigation. Scott grew up in Dallas, Texas, attended Woodrow Wilson High School, received a B.A. in history from Columbia University in 1986, and a J.D. from  Southern Methodist University in 1989. He was admitted to the Texas Bar in 1989. Scott is also admitted to practice before all of the Federal Courts in Texas, the United States Court of Appeals for the Fifth Circuit, the United States Supreme Court, and the United States Tax Court. In 2006 he became Board Certified in Civil Trial Law by the Texas Board of Legal Specialization. Scott has been named a “Texas Super Lawyer” by Texas Monthly Magazine since 2006, and has been listed in Best Lawyers in America since 2008. He has been an adjunct professor of Trial Advocacy at Southern Methodist University’s Dedman School of Law. Scott is active in the Dallas Bar Association and served as the Chair of the Probate Trust and Estate Section.
