False Claims Act Update: A  Discussion of the Latest Federal False Claims Act Cases Handed Down by Various Courts and Their Implication

Chris Rogers, Haynes and Boone, LLP

Chris Rogers is the hiring partner for the Dallas office of Haynes and Boone.  Chris focuses his practice on litigation and government investigations, with an emphasis on healthcare fraud and abuse enforcement. He has represented high-profile healthcare clients in internal investigations and qui tam cases filed under the False Claims Act, including hospital systems and executives, health insurers, clinical laboratories, psychiatric hospitals, ambulatory surgery centers, and physician-owned entities. He represents clients in dealing with a number of government agencies, including the U.S. Department of Justice, the Department of Health and Human Services Office of Inspector General, the Securities and Exchange Commission, and various state attorney general’s offices.

Chris counsels clients on a wide array of healthcare regulatory compliance matters with an emphasis on fraud and abuse enforcement issues arising under the False Claims Act, the Anti-Kickback Statute, and the Stark Law. He represents clients at every stage of FCA civil or parallel criminal proceedings as well as in litigation in state or federal court.  Chris is experienced in the appropriate use of statistical extrapolation in government enforcement or litigation, efficient project management of large scale investigations or outside expert reviews, and issues that surround compliance audits or voluntary self-disclosures. 

Chris has successfully litigated cases to verdict in state and federal court and advocated on behalf of clients in a variety of administrative proceedings. In numerous cases, his clients have effectively leveraged affirmative counterclaims or other offensive strategies to “level the playing field” and reach a successful conclusion to their litigation matters.

Chris is recognized as a Texas Super Lawyers Rising Star, Thomson Reuters, in the Dallas legal community (2011-2013; 2015-2018) and maintains an active role in the American Bar Association, the American Health Lawyers association, the Dallas Bar, and his local community (LD ’15).

 

Nicole Somerville, Haynes and Boone, LLP

Nicole Somerville serves as a trusted advisor to a variety of clients within the healthcare industry in complex litigation matters and internal investigations. Nicole has helped hospital systems, laboratories, nursing homes, insurance companies, and physicians navigate complex fraud and abuse laws, including the False Claims Act, the Anti-Kickback Statute, the Stark Law, and the Civil Monetary Penalties Law.

Nicole’s practice is largely focused on False Claims Act qui tam litigation. She has defended clients in False Claims Act matters throughout the country involving alleged violations of the Stark and Anti-Kickback Statutes related to medical office building leasing, medical directorships, physician employment, and clinical research. She has also defended clients in False Claims Act matters involving allegations of improper billing and medical necessity. In addition, Nicole routinely assists her clients in responding to Civil Investigative Demands under the False Claims Act and other administrative subpoenas, as well as self-disclosures to enforcement agencies.

When not working on behalf of her clients, Nicole participates in the American Health Lawyers Association, the DFW Chapter of Women in White Collar Defense, and the Dallas Bar Association.
